The case, which began with a lawsuit by the local news agency ANI last year, will be heard in Delhi. It could affect the legal framework for the use of artificial intelligence in India, which is OpenAI’s second-largest market by number of users. Several digital media companies, including those owned by billionaires Gautam Adani and Mukesh Ambani, have also joined the lawsuit.
In response to the publishers’ claims, OpenAI stated that the company’s web crawlers collect only public data, and the publishers have not provided evidence of the use of original literary works. Meanwhile, the Federation of Indian Publishers claims that ChatGPT uses content from websites that have licensing agreements with publishers.
OpenAI insists that its actions are protected by fair use principles. The company also stated that Indian courts do not have jurisdiction to hear the case, as its servers are located abroad
